Suspected Counterfeit
Private Label Ownership, Evidence and Channel Control
OEM Appliance Brand Protection and Unauthorized Seller Control for Importers
Putting a logo on an air fryer, blender, electric fan or water dispenser pump is only the manufacturing step. A durable private-label program also needs clear ownership records, controlled artwork, authorized-seller evidence, market-specific traceability and a disciplined response when a listing, product or seller appears outside the approved channel.
This guide is for importers, distributors, supermarket buyers and OEM brand owners building wholesale appliance programs. It separates factory evidence from trademark rights, marketplace procedures and distribution contracts. MOQ starts from 1000 PCS. Wholesale only.

Direct Answer for OEM Buyers
Can the factory remove every unauthorized seller?
No. A factory can provide verified manufacturing, order, artwork, packing, batch and shipment records within its scope, but it does not automatically own the buyer's trademark or control a marketplace. The rights owner or authorized representative must use the applicable trademark, copyright, customs, contract and platform procedures. An authentic product offered by an unapproved reseller is also not automatically a counterfeit product or a valid intellectual-property complaint.
Brand protection works best when the evidence is designed before mass production. The importer should decide who owns the brand, where protection is sought, which parties may manufacture or sell, how genuine units are identified, what proof an authorized seller receives and how suspected misuse will be documented. The factory can then align approved artwork, packing versions and traceability records with that commercial plan.
One Controlled Brand File
Connect ownership, authorization, product identity and market evidence
| File section | Controlled record | Decision supported |
|---|---|---|
| Brand owner | Exact legal entity, address, contact and authorized decision-maker. | Who may approve production, authorize representatives and submit a rights complaint. |
| Trademark position | Mark, owner, application or registration status, goods or services, territory, number and renewal owner where applicable. | Which right may exist in the market and which evidence a platform or authority may request. |
| Manufacturing authority | Written approval for the named factory to apply the brand to defined products and packing for the defined order. | Why branded production is authorized and which version was approved. |
| Artwork master | Approved logo, rating label, color box, manual, warranty card, barcode and carton mark with version and date. | Whether a market item or listing matches the authorized presentation. |
| Authorized channels | Distributor, territory, channel, customer type, validity period and evidence of authorization. | Whether a seller can substantiate an authorized commercial relationship. |
| Product traceability | Model, electrical version, batch, serial or other identifier, packing version, PO, invoice and shipment destination. | Whether an examined item connects to a verified production and shipment record. |
| Incident evidence | Listing URL, seller identity, screenshots, test purchase, product photos, identifiers, claims and dated decision log. | Whether the issue concerns counterfeit goods, listing content, distribution, warranty representation or another problem. |
Classify Before Reporting
Five situations can look similar but require different evidence
Unauthorized Listing Content
Brand photos, manuals or descriptions may be used without permission
Preserve the exact content, source ownership, publication date and platform listing. Copyright and trademark questions may differ.Authentic Unauthorized Resale
A genuine item may be sold outside the approved channel
This may be a distribution, exhaustion, parallel-import, warranty or contract question rather than counterfeiting. Obtain market-specific legal advice.False Authorization or Warranty
A seller may claim an appointment or service promise that does not exist
Preserve the seller's exact representation and compare it with the brand owner's authorization and warranty records.Distributor Contract Breach
An appointed party may sell outside agreed territory or channel
Use the governing contract, transaction evidence and qualified legal review. Marketplace IP tools may not enforce private distribution or pricing terms. Before OEM Production
Protect the project before the logo reaches the product
Confirm the brand instruction comes from an authorized party
Record the buyer's legal entity and approval contact. Do not use a third-party logo merely because it appears in a message or image file.
Search and review the target market
The brand owner should search relevant national, regional and international records and obtain qualified advice before filing or using a mark. Similar marks, product classes and territories matter.
Approve one artwork version
Freeze the logo, spelling, color, label, manual, claims, barcode, warranty statement and packing language. Record every later revision.
Define authentic product identifiers
Select practical identifiers that can connect a unit or carton to an actual order. A code is useful only when its creation, use and lookup record are controlled.
Define seller and distributor evidence
Decide what document proves an appointment, who signs it, which products and territory it covers, when it expires and whether verification is available.
Assign post-market owners
Name the people responsible for channel monitoring, evidence preservation, test purchases, platform reports, distributor communication and legal escalation.
Product and Packing Traceability
Use identifiers that answer a real commercial question
| Control | Useful application | Important limit |
|---|---|---|
| Production batch | Connects units to a defined production period, component set or inspection record. | A batch code is not a consumer-authentication system unless a controlled lookup exists. |
| Serial or unique code | Can identify individual units and support warranty, activation or channel review when the system is maintained. | Duplicate prevention, database access, privacy, label security and failed scans require a documented process. |
| Carton or distributor code | Can connect a packing run or shipment to a destination, distributor or campaign. | It should not expose sensitive commercial data to the public. |
| Tamper-evident feature | Can make opening or label replacement more visible. | It does not prove authenticity by itself and cannot prevent every form of copying. |
| Controlled warranty card | Can state the responsible market entity, service route and scope for the authorized program. | Warranty obligations and transferability depend on the market, seller, terms and law. |
| Reference sample | Preserves the approved product and packing appearance for comparison. | Appearance alone cannot resolve every component, patent, origin or legal question. |
Identifier design should match the product value, sales channel and after-sales process. A low-cost pump sold through multiple wholesalers may need a different control from a branded air fryer sold through appointed supermarket chains. Features, software, database hosting and per-unit costs require order-specific confirmation.
Suspected Listing Evidence
Capture the listing and the physical product before it changes
Listing Identity
Preserve the exact online offer
Platform, country, URL, listing or offer ID, seller name, price, stock claim, delivery promise, date, time and complete screenshots.Rights Evidence
Identify the right and the authorized reporter
Trademark or copyright owner, territory, status, registration where applicable, goods or services and representative authority.Test Purchase
Preserve the transaction chain
Order confirmation, invoice, payment, seller messages, shipping label, unopened parcel, first opening, product and packing. Follow local law and adviser instructions.Physical Comparison
Compare controlled features without guessing
Model, rating label, plug, cord, construction, accessories, code, manual, logo, color box and master carton against verified reference records.Supply-Chain Check
Ask whether the item could be genuine
Review production, shipment, distributor, return, liquidation and warranty records before describing the source.Decision Log
Record each report and outcome
Named approver, evidence reviewed, platform form, statement submitted, case number, response, appeal, correction and closure date.Marketplace and Customs Routes
Use the official procedure that matches the verified right
Identify the rights owner or authorized representative
Platform programs commonly restrict intellectual-property reporting tools to rights owners or properly appointed agents. Preserve the authorization.
Select the correct complaint basis
Trademark, copyright, patent, design, counterfeit, misleading authorization and private distribution disputes are not interchangeable.
Submit only verified evidence
False or overbroad reports can damage the brand and may create legal or platform consequences. Do not use IP reporting solely to control price or ordinary resale.
Preserve the platform case
Keep the submitted statement, evidence, case number, response, removed or restored listing status and any counter-notice or appeal.
Consider customs tools only with qualified advice
Some jurisdictions provide customs recordation or applications for action. Eligibility, proof, bonds, product identification and procedures are market-specific.
Platform removal is not proof that every unit is counterfeit, and a listing that remains active is not proof that it is authorized. Platform decisions, customs actions, contract enforcement and court remedies use different standards and records.

Controlled response after verification
Evidence comparison, production review and approved future-order changes without making legal conclusions about a seller or product.Response Decision Matrix
Match the response to the verified issue
| Verified issue | Primary route | Do not assume |
|---|---|---|
| Copied brand image or text | Rights-owner review of copyright, trademark, platform content and authorization evidence. | That every copied element has the same owner or legal status. |
| Suspected counterfeit product | Controlled test purchase, reference comparison, rights and supply-chain review, then authorized platform, customs or legal action. | That a low price, different seller or packaging variation proves counterfeiting. |
| Authentic product outside channel | Review source, territory, exhaustion or parallel-import rules, distributor contract and warranty representation with local counsel. | That an IP complaint can enforce every selective distribution term. |
| False authorized-dealer claim | Preserve the claim, compare the appointment record and review consumer, trademark, contract and platform options. | That seller removal, damages or a particular remedy is guaranteed. |
| Distributor leakage | Transaction tracing, contract notice and commercial or legal escalation under the governing agreement. | That the factory owns the brand relationship or can impose a remedy outside its contract. |
| Factory record mismatch | Freeze assumptions, verify artwork, production and shipment records, preserve samples and investigate the actual scope. | That one mismatched feature establishes origin or responsibility. |
Official Reference Routes
Use rights, customs and platform sources for the target market
These official sources explain why brand protection requires territorial rights, accurate ownership records and issue-specific procedures. They do not decide whether a particular listing, seller or product infringes a right.
This page is a B2B operational control guide, not trademark, copyright, patent, customs, competition, distribution, tax or legal advice. Rights, exhaustion, parallel import, authorized resale, customs action, platform reporting, warranty statements and contractual remedies differ by country, facts and agreement. The brand owner should use the relevant IP office, marketplace, customs authority and qualified local professionals. Never file a false report, claim rights that are not owned or promise removal, damages, exclusivity or enforcement outcomes.
